These Terms of Service ("Terms") govern your use of ARKIVE's website and services. By placing an order or
using our services, you agree to these Terms.
1. Our Service
ARKIVE creates custom sculptural artifacts based on photographs you provide. Each artifact is a handcrafted,
one-of-a-kind physical item. The final physical product may vary slightly from the AI-generated concept
preview shown during the creation process.
2. Orders and Payment
- All prices are in USD and are subject to applicable sales tax
- Payment is processed securely by Stripe at the time of order
- Your order is confirmed once payment is successfully processed
- We reserve the right to cancel orders we cannot fulfill, with a full refund
3. Production and Delivery
- Production typically takes 2–3 weeks after your order is confirmed
- Delivery within the United States is included in the product price
- Estimated delivery times are not guaranteed; delays may occur due to manufacturing or shipping factors
outside our control
- We will notify you by email as your artifact progresses through production
4. Returns and Refunds
Custom-Made Items: Because each artifact is created specifically for you using your photos,
we are unable to accept returns or exchanges for reasons other than defects or damage during shipping.
- Damaged or defective items: Contact us within 7 days of delivery with photos of the
damage. We will replace or refund at our discretion.
- Cancellations: You may cancel your order within 24 hours of placing it for a full
refund. After 24 hours, production may have already begun and cancellations cannot be accommodated.

5. Your Photos and Content
- You represent that you have the right to share the photos you upload — either you took them or have
permission from the subjects
- You grant ARKIVE a limited license to use your photos solely to create your artifact
- We will not use your photos for marketing without your explicit written consent
- You remain the owner of your photos
6. AI-Generated Concepts
The design concepts shown during the creation process are AI-generated previews and may differ from the final
physical artifact. The AI concept is used as a design guide — it does not represent a photorealistic preview
of the final product.
7. Acceptable Use
You may not use our services to create artifacts from photos that:
- Depict content that is illegal or violates the rights of others
- You do not have the right to use
- Contain sexually explicit or hateful content
We reserve the right to refuse any order that violates these guidelines.
8. Intellectual Property
ARKIVE retains ownership of the design process, software, and AI systems used to create your artifact. You
own the physical artifact and the photos you provided.
9. Limitation of Liability
To the maximum extent permitted by law, ARKIVE's liability for any claim arising from these Terms or your use
of our services is limited to the amount you paid for your order.
10. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law
principles.
